Dental Negligence – Claims on the rise

A claim type we have seen on the increase recently is Dental Negligence. These claims arise from dental malpractice or negligence and can result in avoidable injury.

Many Dental Negligence claims occur when a patient suffers injury to their teeth due to dental mistreatment which can cause ongoing pain and discomfort; or in some cases changes to patient’s physical appearance can be caused as a result of dental malpractice. These incidents can cause not only physical pain, but psychological suffering or financial loss.

Dental Negligence funding we will consider

We provide funding for Claimants pursuing Dental Negligence which include, but are not limited to:

  • Delayed or incorrect diagnosis
  • Misdiagnosis
  • Periodontal disease
  • Nerve injuries
  • Negligence / failure to provide a treatment plan, preventative or oral hygiene advice

Our Dental Negligence funding can be used to fund the expenses, such as court fees and expert medical reports, incurred when pursuing a claim for restorative treatment and compensation for pain, suffering and loss of amenity.

How does the funding work?

The funding is provided as a loan and the repayment of the loan is secured by an assignment of the Claimant’s ATE Insurance Policy and undertakings given by the solicitor managing the claim in relation to the proceeds payable under the claim. In the event that a claim is lost or discontinued, the loan is repaid to Affiniti Finance from the insurance policy proceeds.

We charge interest on a simple, not compound, basis and this interest is not payable until the claim is resolved.
